ITEMS INCLUDED AND CHARGES: All included items will be shown with their Model and Serial # on the order confirmation receipt included with your order shipment and will serve as your Bill of Sale, pursuant to ARS 36-1909 and R9-16-313(A)(8). The Manufacturer of each hearing aid is Hearing Central LLC, unless noted otherwise.

OTHER TERMS & CONDITIONS: All hearing devices remain the property of Hearing Central LLC until paid in full. Unless otherwise noted, the hearing devices are new from the manufacturer. Hearing Central provides Purchaser with a two (2) year repair warranty on all parts and workmanship. Hearing Central also provides Purchaser with a 90 day trial period that entitles Purchaser to return their hearing devices within 90 days from the date of receipt for a refund of their purchase price.

All returned hearing aids and packaging must be returned with no markings or damage. If Purchaser writes indelible ink on the hearing aids or mar them in any way there will be a damage fee of $80 per hearing aid.

The Purchaser understands that the measurement of human hearing is for the purpose of making selections for the sale of hearing devices and is not an examination, diagnosis, or a prescription by a person licensed to practice medicine and therefore must not be regarded as a medical opinion or advice.

AUDIO SWITCH: Purchaser acknowledges that they have been informed on audio switch technology (also known as a telecoil, t-coil or t-switch) and their proper use (if available on the hearing aid they have purchased), including benefits such as increased access to phones and assistive listening devices.

AZ STATE PROGRAM: Purchaser is aware of the Arizona telecommunications equipment distribution program established by ARS Section 36-1947, that provides assistive telecommunications devices to residents of Arizona who have hearing loss.

The manufacturer’s warranty is in lieu of all other warranties or remedies. Hearing Central hereby disclaims all warranties, including the warranty of merchandability and fitness for a particular use or purpose. The Purchaser waives any and all claims against Hearing Central and its agents or employees. Purchaser agrees that the limited warranty is the only warranty applicable to hearing aids and their purchase.

MANUFACTURER’S LIMITED WARRANTY: The manufacturer warranties the hearing aid against defects in material or workmanship for a period of 2 years from the initial date of purchase or Purchaser’s receipt, whichever comes later. This warranty does not cover accessories such as batteries, tubing, wax filters, domes, cleaning tools, etc.. Under this warranty, Hearing Central will at its option: a) repair the device; or b) replace the hearing aid with a new hearing aid or refurbished hearing aid. In case of a defect in material or workmanship, these are your Purchaser’s exclusive remedies.

To obtain warranty service, Purchaser must deliver the hearing aid to the office of Hearing Central. This limited warranty only covers product failures caused by defects in material or workmanship during ordinary consumer use. No warranty coverage will be provided for any other reason, including but not limited to misuse or improper care, acts of God, accidents or trauma to the device, overuse, repair by an unauthorized party, exposure to corrosive conditions, physical changes in the ear of the Purchaser, or damage due to foreign objects or fluids entering the device.

LIMITATION ON DAMAGES: Hearing Central will not be liable for any special, indirect, consequences resulting from use of devices or resulting from any breach of any express or implied warranty on the devices. If liability by Hearing Central is established for any reason or any reason, including, without limitation, breach of warranty, the sole and exclusive remedy of Purchaser shall be the recovery of an amount not to exceed the original price charged by Hearing Central to the Purchaser for the hearing aids.

CONFLICT RESOLUTION: In the event that a conflict can not be resolved through negotiations between the parties, then the parties agree that all disputes will be submitted to private mediation. If the parties can not agree on a mediator, then the presiding judge of the civil division of the Superior Court of Maricopa County, Arizona will appoint a mediator. If mediation is unsuccessful in resolving conflicts, then all disputes will be subject to the jurisdiction of the Superior Court of Maricopa County, Arizona in the Northwest Judicial District. The prevailing party shall be entitled to recover all court costs and all attorney’s fees incurred in the unsuccessful mediation and legal action.

ARIZONA LICENSE TO DISPENSE: Edward A. Maznio, Arizona Hearing Aid Dispenser License #HAD4599 is the licensed dispenser of each hearing aid.

By completing an online purchase, Purchaser acknowledges by electronic submission that they have read and understand the Terms and Conditions of the sale as outlined above, and if possible, would sign their name acknowledging the same.

Introduction

At Hearing Central LLC, we are committed to treating and using protected health information about you responsibly. This Notice of Health Information Practices describes the personal information we collect, and how and when we use or disclose that information. It also describes your rights as they relate to your protected health information. This Notice is effective and applies to all protected health information as defined by federal regulations.

Understanding Your Health Record/Information

Each time you purchase from HearingCentral.com, a record of your purchase is made. Typically, this record contains your test results, diagnoses, treatment, and a plan for future care or treatment. This information, often referred to as your health or medical record serves as:

  • Basis for planning your care and treatment;
  • Means of communication among the many health professionals who contribute to your care;
  • Legal documents describing the care you received;
  • Means by which you or a third-party payer can verify that services billed were actually provided;
  • A tool in educating health professionals;
  • A source of data for medical research;
  • A source of information for public health officials charged with improving the health of this state and the nation;
  • A source of data for our planning and marketing; and
  • A tool with which we can assess and continually work to improve the care we render and the outcomes we achieve.

Understanding what is in your record and how your health information is used helps you to: ensure it’s accuracy; better understand who, what, when, where, and why others may access your health information; and make more informed decisions when authorizing disclosure to others.

Your Health Information Rights

Although your health record is the physical property of Hearing Central LLC, the information belongs to you. You have the right to:

  • Obtain a paper copy of this notice of information practices upon request;
  • Inspect and copy your health record as provided for in 45 CFR 164.524;
  • Amend your health record as provided in 45 CFR 164.528;
  • Obtain an accounting of disclosures of your health information as provided in 45 CFR 164.528;
  • Request communications of your health information by alternative means or at alternative locations;
  • Request a restriction on certain uses and disclosures of your information as provided by 45 CFR 164.522; and
  • Revoke your authorization to use or disclose health information except to the extent that action has already been taken.

Our Responsibilities

Hearing Central LLC is required to:

  • Maintain the privacy of your health information;
  • Provide you with this notice as to our legal duties and privacy practices with respect to information we collect and maintain about you;
  • Abide by the terms of this notice;
  • Notify you if we are unable to agree to a requested restriction; and
  • Accommodate reasonable requests you may have to communicate health information by alternative means or at alternative locations.

We reserve the right to change our practices and to make the new provisions effective for all protected health information we maintain. Should our information practices change, we will mail a revised notice to the address you’ve supplied us, or if you agree, we will email the revised notice to you.

We will not use or disclose your health information without your authorization, except as described in this notice. We will also discontinue to use or disclose your health information after we have received a written revocation of the authorization according to the procedures included in the authorization.

Purchaser acknowledges that they are 18 years of age or older and that they have been advised by Hearing Central LLC that the Food and Drug Administration (FDA) has determined that their best health interest would be served if they had a medical evaluation by a licensed physician (preferably a physician who specializes in diseases of the ear) before purchasing a hearing aid. Purchaser does not wish to to have a medical evaluation before purchasing a hearing aid.

Additional Considerations 

If you have or think you may have any of the following conditions, Hearing Central LLC advises you to consult promptly with a licensed physician (preferably an ear specialist) prior to purchase:

  • Visible deformity of the ear
  • Fluid or drainage from the ear within the past 90 days
  • Sudden, rapidly progressing, or fluctuating hearing loss
  • Spells of acute or chronic dizziness
  • Hearing loss only on one side that worsened in the past 90 days
  • Ear canal blockage, a lasting ear infection or a plugged up fullness feeling
  • Excessive wax buildup, or a history of excessive wax buildup
  • Pain or discomfort in the ear
  • Ringing in one or both ears within last 90 days

You are purchasing a hearing aid based upon the information you have submitted to Hearing Central LLC. Any examination or representation made by a hearing aid provider or audiologist in connection with the practice of dispensing, fitting, or dealing in hearing aids is not an examination, diagnosis, or prescription by a person licensed to practice medicine and, therefore, must NOT be regarded as medical opinion or advice. A hearing aid will NOT restore normal hearing, nor will it prevent further hearing loss. It is also recommended that an Otoscopic exam is preformed before the purchase of a hearing aid.

You also agree that you are the person that will be the end user and wearer of these hearing aids, and that the reason for purchasing these hearing aids from Hearing Central LLC is for the sole purpose of personal use only and not for competitive research, resale, or any other reason.

HearingCentral.com may contain links to other sites on the Internet that are owned and operated by third parties. You acknowledge that we’re not responsible for the operation of or content located on or through any such site.

We accept money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. Orders are processed upon receipt of a money order or cashier’s check. For personal and company checks, please allow up to 10 banking days after receipt for clearance of funds before the order is processed. We cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks.

For a multiple product order, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless you inform us otherwise. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. These Conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether Hearing Central LLC signs them or not. We reserve the right to make changes to this site and these Conditions at any time, without notice.

We will ship your product as it becomes available. Usually, products ship the same day if ordered by 5:00PM, or by the next business day if your order is received after this time and for orders received on Saturday, Sunday or any major U.S. holiday. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. You may cancel your order at any time prior to shipping.

We keep your personal information private and secure. When you make a purchase from our site, you provide your name, email address, credit card information, address, phone number, and a password. We will gladly accept the return of hearing aids that are defective due to defects in manufacturing and/or workmanship for 90 days from the date of purchase. Fulfillment mistakes that we make resulting in the shipment of incorrect product to you will also be accepted for return 90 days from the date of purchase.

Most orders received before 5:00PM will ship the same day, provided the product ordered is in stock. Most orders received after 5:00 PM will ship the next business day. Orders are not processed or shipped on Saturday except by prior arrangement.  No shipments will be made on Sunday or on major U.S. holidays, due to closures at the U.S. Postal Service.

We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by HearingCentral.com only as an estimate. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability.

HearingCentral.com shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within the same state for taxable merchandise. For orders shipped to other states, you are solely responsible for all sales taxes or other taxes.

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, HearingCentral.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. HearingCentral.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, HearingCentral.com shall immediately issue a credit to your credit card account in the amount of the incorrect price.
